The petitioners apprehend their arrest in Naubatpur P.S. Case No. 267 of 2015, registered for the offences punishable under Sections 420, 406 and 34 of the Indian Penal Code. The informant alleged that the petitioners introduced him to Alok Kumar Sinha who agreed to sale a piece of land on consideration of Rs. 9,19,000/-. The petitioners disclosed that Alok Kumar Sinha has purchased the aforesaid land from them but Alok Kumar Sinha even after execution of the deed of agreement to sale did not execute the sale deed after receipt of the consideration amount.
Learned counsel for the petitioners submits that the
Patna High Court Cr.Misc. No.49725 of 2016 (2) dt.21-12-2016 2/2 petitioners have not received any farthing from the informant. Considering the facts aforesaid, the petitioners above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, Danapur, Patna in Naubatpur P.S. Case No. 267 of 2015, Subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
