2. The petitioners seek regular bail in connection with Bihta P.S. Case No. 37 of 2026, corresponding to Spl. (NDPS) Case No. 76/2026, registered for the offence punishable under Sections 8(c), 21(b) and 22(b) of the N.D.P.S. Act.

3. As per prosecution case, 78.35 grams of smack has been recovered from the possession of the petitioners and the co-accused persons, namely, Mukesh Kumar.

4. Learned counsel for the petitioners submit that the petitioners are innocent and have committed no offence. No

The petitioner no. 1 has one criminal antecedent in which he is on bail whereas petitioner no. 2 has clean antecedent and they are in custody since 14.01.2026.

5. Learned A.P.P. for the State has opposed the prayer for bail.

6. Considering the facts and circumstances of the case and period of custody, this bail application is allowed.

Let the petitioners above named, be granted bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand Only) each with two sureties of the like amount each to the satisfaction of learned Court concerned where the case is pending/successor court in connection with Bihta P.S. Case No. 37 of 2026, corresponding to Spl. (NDPS) Case No. 76/2026, subject to condition that:

(i). The petitioners shall mark their attendance at Bihta Police Station on every Sunday of each month. In the event of default, the bail bonds shall be liable to be cancelled

8. It is made clear that any observation made herein is prima facie in nature and limited solely for the purpose of adjudication of the present bail application. Such observations
