2. Petitioner apprehends arrest in a case registered for the offences punishable under Sections 302, 349 of the Indian Penal Code and Section 27 of the Arms Act.
3. As per F.I.R., four unknown miscreants riding on motorcycle shot husband of the informant, who died on the spot.
4. It is submitted that petitioner is not named in the F.I.R. and name of the petitioner transpired during investigation on the confessional statement of co-accused Subhash Sharma, who is nephew of the deceased. Co-accused Subhash Sharma disclosed that at the time of the incident, this petitioner was seen talking with other accused persons on mobile phone and except the confessional statement there is no other material on record to show complicity of the petitioner in the present case.

Considering the backdrop of the case and the fact that petitioner is not named in the F.I.R., this anticipatory bail is allowed and it is ordered that let the above named petitioner in the event of his arrest/surrender before the court below within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Araria in connection with Raniganj P. S. Case No. 258 of 2023, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Singh, J) Navya/- U T
