JUSTICE MOHIT KUMAR SHAH ORAL ORDER 09-05-2018 The learned counsel for the petitioners has filed the present modification petition for granting extension of time in connection with the time which was granted for surrendering before the lower court for the purposes of grant of anticipatory bail.

The learned counsel for the petitioners submits that though the petitioners have been granted anticipatory bail vide order dated 12.02.2018 passed in Cr. Misc. no. 665 of 2018 and the petitioners were directed to surrender within a period of six weeks from the date of receipt/ production of a copy of the said order, the petitioners could not surrender within the said time frame since their mother was ill and admitted at Delhi.

No.28597 of 2018 (2) dt.09-05-2018 2/2 In view of the aforesaid, the present modification petition is allowed and the time granted for surrendering is extended by a further period of four weeks from today and it is directed that in case, the petitioners surrender within four weeks from today, they would be granted anticipatory bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) each with two sureties of the like amount each to the satisfaction of Sub-Divisional Judicial Magistrate, Sherghati at Gaya in connection with Raushanganj PS case no. 111 of 2015 subject to the conditions as laid down under Section 438(2) of Code of Criminal Procedure.
