2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 302, 201 and 34 of the Indian Penal Code.
3. The case of the prosecution is that the son of the informant was missing, he went to search his son and he found, Sattar Mian and Sanullah Mian in the fields, they informed that as the pigs delivered piglet, the area became dirty which has been cleaned. Informant found the drops of blood on the ground as well as on the crops of wheat. The informant upon suspicion, removed the recently filled earth and found the dead body of his son.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. Learned counsel for the petitioner has submitted that the name of this petitioner is not there in the FIR rather only two persons are named in FIR, namely, Sattar Mian and Sanullah Mian. During course of investigation it was found at belated stage that the petitioner had talks with the deceased from a stolen mobile. Learned counsel has submitted that save and except CDR of the mobile which goes to show that the petitioner had talks with the deceased, there is nothing against him. Learned counsel has further submitted that other co-accused person Sattar Mian has been granted bail by learned co-ordinate Bench of this Court vide Cr. Misc. No. 35474 of 2019. The case of this petitioner stands on better footing. Moreover, the petitioner is languishing in judicial custody since 05.01.2026.
5. Learned APP appearing for the State has vehemently opposed the prayer of regular bail.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Shikarpur P.S. Case No. 71 of 2018 on furnishing bail bond of
Patna High Court CR. MISC. No.27354 of 2026(3) dt.24-06-2026 3/3 Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-VI, Bettiah, West Champaran.
