2. The petitioner has prayed for regular bail in a case registered for the offence punishable under section 96 of BNS and Sections 8 and 12 of the POCSO Act.

3. The case of the prosecution is that the petitioner has kidnapped the minor daughter of the informant.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. Learned counsel for the petitioner has submitted that during course of investigation, the victim was recovered and she has given her statement recorded under Section 183 of BNSS wherein she has stated that as her mother was forcing her to marry, she has gone to

Learned counsel has submitted that the statement of the victim goes to show that she has gone with the petitioner with her own volition. Petitioner has neither enticed nor induced her for following him. A statement has been made in para3 of this petition that the petitioner has got no criminal antecedent. Moreover, he is languishing in judicial custody since 24.01.2026.

5. Learned APP for the State has vehemently opposed the prayer for bail.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Kinjer P.S. Case No. 125 of 2025 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge VIcum Special POCSO Court, Jehanabad or concerned Court Jehanaband.
