The petitioner apprehends his arrest in a case registered for the offence under Section 394 of the Indian Penal Code.

As per the prosecution case, while the informant alongwith his Manager were returning after selling gas and reached near Chiraiya police station at 3:30 PM, two miscreants riding on a motorcycle chased the pick-up van of informant and on the point of pistol, snatched cash and also caused fire-arm injury to the informant and his Manager Tara Chand Prasad. Petitioner is not named in the F.I.R. Name of the petitioner transpired during course of investigation. Petitioner has been made accused on the basis of his confessional statement recorded in connection with Chiraiya P.S.Case No. 506

Patna High Court CR. MISC. No.37876 of 2021(3) dt.28-07-2022 2/2 of 2019. No stolen article has been recovered from the possession of the petitioner..

However, learned A.P.P. for the State opposes the prayer for anticipatory bail and submits that petitioner has got three criminal antecedent and during investigation, name of petitioner transpired.

Considering the aforesaid facts and circumstances, the prayer for anticipatory bail of petitioner is rejected. (Prabhat Kumar Singh, J) anay/- U T
