Mr. Mohammed Arif ====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 02-05-2019 Heard learned counsel for the petitioner and the counsel appearing on behalf of the State.

The petitioner is in custody in connection with Hajipur Rail P.S. Case No. 136 of 2018 for the offences under Sections 307, 328, 379 and 34 of the Indian Penal Code. Learned counsel for the petitioner submits that the petitioner has no criminal antecedent and he is in custody since 22.12.2018. He further submits that allegation against this petitioner is that he was involved in offering Jalebi Puri and after taking Jalebi Puri the informant felt drowsiness and thereafter the belonging of informant was taken away by the petitioner. He further submits that co-accused namely Ranjit Kumar has been granted bail by co-ordinate Bench of this Court in Cr. Misc. No. 12164 of 2019 vide order dated 11.03.2019.

No.29241 of 2019(2) dt.02-05-2019 2/2 Considering the fact that petitioner has no criminal antecedent and other co-accused has been granted bail by coordinate Bench of this Court, the Court is inclined to grant bail to the petitioner, let the petitioner, named above, be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of Court of learned Additional Chief Judicial Magistrate (Railway), Sonpur (Saran) in connection with Hajipur Rail P.S. Case No. 136 of 2018 .
