1. Heard the learned counsel for the petitioner and the learned APP for the State.

2. On query of the Court with regard to the stage of the case, the learned counsel for the petitioner submits that despite his best endeavour, he could not contact the petitioner nor the petitioner ever contacted him in these six years, as such, he is not in a position to inform the court with regard to the stage of case presently.

3. The learned APP Mr. Chandra Bhushan Prasad at this stage submits that the order of cognizance is dated 17.07.2016, as such, much time have elapsed and the stage of the case might have changed or the trial may have been concluded, as such, the court should not interfere with the order of cognizance.

4. Considering the submission made by the learned APP, the Court is not inclined to entertain the quashing application.

5. Accordingly, the present quashing application is hereby rejected.
