====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 23-09-2024 Heard learned counsel for the petitioner, learned A.P.P. for the State and learned counsel appearing on behalf of complainant / opposite party no. 2.

2. The petitioner, husband of opposite party no. 2, apprehends his arrest in a complaint case punishable for the offence under Sections 498A, 323, 504, 406, 120B of the Indian Penal Code and Section 4 of the Dowry Prohibition Act.

3. At the outset, learned counsel for the petitioner submits that both parties have entered into compromise to settle the dispute outside the Court. By way of referring to paragraph

No.31004 of 2024(5) dt.23-09-2024 2/3 nos. 3 & 4 of the supplementary affidavit, learned counsel for the petitioner submits that petitioner offered Rs. 10,00,000/- (Rupees Ten lacs), as full and final settlement, to the opposite party no. 2 in installment, which has been accepted by opposite party no. 2.

4. Learned counsel for the opposite party no. 2 does not dispute the contention made by learned counsel for the petitioner.

5. Considering the fact that dispute between the parties has been resolved, the prayer for anticipatory bail of petitioner is allowed.

6. Let the petitioner, as named above, in the event of arrest/surrender within a period of eight weeks from today, be enlarged on bail on furnishing bail-bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. - VIII, Vaishali at Hajipur in connection with Complaint Case No. 74 of 2021, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure with further condition that petitioner shall abide by all the terms & conditions, mentioned in compromise petition (Annexure 3 to the supplementary affidavit), failing which, learned Court below shall be at liberty to cancel the
