1. Heard the parties
2. The petitioners seek regular bail in connection with Gadhara (Garhara) P. S. Case No. 20 of 2026 registered for the offences punishable under Sections 190, 126(2), 329(4), 308(4), 74, 76, 302(2), 109(1), 351(2), & 351(3), 352 of the BNS. 3.
The main submissions advanced by the petitioner's counsel are that the petitioners are innocent and have been falsely implicated in the present case due to long standing land and pattidari dispute running between the parties and the occurrence took place on 04.02.2026 whereas the FIR was instituted on 08.02.2026 after a delay of about 4 days without proper explanation and this delay itself creates serious doubt
Patna High Court CR. MISC. No.32029 of 2026(2) dt.12-05-2026 2/3 regarding the genuineness of the prosecution story. It is further submitted that the present case is counterblast to Gadhara P.S. Case No. 18 of 2026 instituted earlier by the petitioner no.1 on 05.02.2026 against the prosecution side regarding the assault committed upon the petitioners and their family members and the petitioner no.1 himself sustained head injury in the said occurrence, though the allegation has been made regarding assault by an iron rod with intention to kill, the injury report of the injured Fuddi Devi discloses only simple injury in nature and the petitioners have no criminal antecedent and have been languishing in jail since 15.02.2026.
4. Learned APP appearing for the State has opposed the bail prayer of the petitioners.

In the facts and circumstances of this case and considering the statements made in the petition as well as above submissions, coupled with the facts that both the parties are agnates in between them there is case and counter case and in the present matter only one person is said to have sustained injury which has been opined to be simple in nature as stated by the petitioners' counsel, this court is inclined to enlarge the petitioners on bail, accordingly, let the petitioners named-above be enlarged on bail in connection with Gadhara (Garhara) P. S.
