The petitioner seeks bail in Gobindganj (Malahi) P.S. Case No. 380 of 2019 registered for the offence under Sections 341/342/323/326/307/498(A)/34 of the Indian Penal Code and Sections 3/4 of the D.P. Act and later on, Section 304(B) of the IPC was also added.

As per prosecution case, this petitioner was married with deceased four years ago and it is alleged that after the marriage, petitioner and his family members started demanding motorcycle, as dowry, and due to non-fulfillment of the same, all the accused persons, including petitioner, poured kerosene oil on the body of informant (deceased) and set her on fire, who

It is submitted on behalf of petitioner that petitioner is a dailywager and never demanded dowry from the family of the deceased. It is further submitted that deceased was caught fire, while she was cooking.

However, learned A.P.P. for the State has vehemently opposed the bail application and submitted that petitioner happens to be husband of the deceased and there is specific allegation against him and post-mortem report also supports the prosecution case.

Considering the aforesaid facts and circumstances, the bail application of petitioner stands dismissed. (Prabhat Kumar Singh, J.) anay/- U T
