Mr. Dinesh Singh, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE PURNENDU SINGH ORAL ORDER 10-04-2023 Heard Mr. Nagadeo Choubey, learned counsel appearing on behalf of the petitioner and Mr. Dinesh Singh, learned APP appearing on behalf of the State.

2. The petitioner apprehends his arrest in connection with Digha P.S. Case No. 720 of 2021 registered under Section 498(A) of the Indian Penal Code and Section 3/4 of the Dowry Prohibition Act.

3. It has jointly been informed to this Court that the couple have reconciled their strained matrimonial relationship and are living together. The agreement of settlement is also annexed along with the report of the learned Mediator dated 04.04.2023.

4. Considering the positive steps taken by the couple

Patna High Court CR. MISC. No.28501 of 2022(6) dt.10-04-2023 2/2 on the indulgence of the learned Mediator, the Court below is directed to enlarge the petitioner provisionally on pre-arrest bail to see the conduct of the parties who are husband and wife that they are leading a happy matrimonial life. In case no allegation is made by Opposite Party No. 2 against the petitioner the provisional bail is required to be made absolute on such terms and conditions as fixed by the Court below.

5. In case Opposite Party No. 2 is not willing to pursue with the matter she may take remedial measures in accordance with law even before the aforesaid period and in that case the Court below must pass an appropriate order in accordance with law.

6. Accordingly, the present bail application is disposed of.
