JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 02-03-2017 Heard learned counsel for the petitioners and learned A.P.P. for the State.
The petitioners apprehend their arrest in connection with Natwar P. S. Case No. 03/2016 registered for offences punishable under Sections 406, 407, 408, 409, 467, 468, 420 and 120 (B) of the Indian Penal Code.
Patna High Court Cr.Misc. No.2485 of 2017 (2) dt.02-03-2017 2/3 Accusation is of committing the irregularities in procurement of the paddy for the financial year 2014-2015 in collusion with Circle Officer, Dinara at present Assistant Consolidation Officer, Semari (Buxar), Clerk, Circle Office, Dinara, PACS Chairman, Dinara and Karhani and the farmers. Learned counsel appearing on behalf of the petitioners submits that the petitioners are farmers and they had supplied the paddy according to Enforcement Order issued by Anchal Adhikari. Moreover, irregularities, as pointed out is that while according to Jamabandi, total area was 1.25 Acres, 1.97 Acres lands, 3.69 Acres lands, 3.41 Acres and 3.74 Acres and 1.04 Acres of the petitioner but area of their land shown in the enforcement order as 11.25 acre, 11.97 acre, 13.69 acre and 13.74.
Further submission is that the petitioners, who are farmers had supplied the paddy as directed by Anchal Adhikari, Dinara, as such they had no concern with the alleged irregularities. Having considered the facts and circumstances of the case, let the petitioners, above named, in case of arrest or surrender within a period of six weeks be enlarged on bail on furnishing bail bond of Rs.
