====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 30-04-2019 Heard learned counsel for the petitioner and the State.

The petitioner seeks bail in Mojahidpur (Babarganj) P.S. Case No. 117 of 2018, instituted for the offence under Section(s) 395 of Indian Penal Code. It is alleged in the written report that on the date of occurrence, 5-6 miscreants surrounded the informant near a speed breaker and on the point of weapons looted Rs.40,000/- cash and other valuable articles. They were calling their names Kundan, Ritesh, Rajkumar, Dilip Paswan (petitioner) and Niraj Yadav.

Counsel for the petitioner submits that no Test Identification parade has been held. There is no recovery of any incriminating article from possession of this petitioner. He

Patna High Court CR. MISC. No.27981 of 2019(2) dt.30-04-2019 2/2 further submits that other co-accused have already been granted bail by this Court vide orders dated 11.01.2019 and 30.01.2019 passed in Cr. Misc. 73743 of 2018 and 3741 of 2019 respectively.

Petitioner is in custody since 18.6.2018.

Considering the aforesaid facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned 7th Additional District & Sessions Judge, Bhagalpur, in connection with Mojahidpur (Babarganj) P.S. Case No. 117 of 2018, subject to the condition that both the bailors will be close relatives of the petitioner.
