2. The present petition has been preferred for the following relief/s:

(i) to Issue appropriate order/direction, writ/writs, preferably in the nature of Mandamus, commanding and directing the Respondent authority concerned, not to

Patna High Court CWJC No.7534 of 2026(3) dt.28-07-2026 2/3 disturb the Ralyati land of the petitioner and forthwith stop the construction work of Block/Panchayat building over the land of petitioners appertaining to Khata No. 852, Plot No.506, total area 12 Katha, situated in Mauza Amarpur, Block Anchal Darauli, District Siwan which has been settled in the name of ancestors of petitioners in the year 1952 by the Ex-landlord prior to vesting of Jamindari and after abolition of Jamindari, return was-fited in their favour by the Exlandlord and accordingly, Jamabandi No.31 has been created in favour of Bindhyachal Rai and others (Ancestors of the petitioners) and rent receipt is being issued in favour of petitioners;

(ii) to restrain the Respondents concerned from making any further construction of the building of Block/Panchayat over the aforesaid raiyati land of the petitioners, during pendency of the instant writ petition; (iii) any other relief(s) for which petitioners

Patna High Court CWJC No.7534 of 2026(3) dt.28-07-2026 3/3 are found entitled in facts and circumstances of this case.

3. After some argument, learned counsel for the petitioners submits that it will suffice that their case is taken up by the Collector, Siwan as the land was admittedly settled in the year 1952 by ex-land lord.

4. Learned State counsel has no objection to the said stand of the petitioner.

5. In that background, the writ petition is disposed of allowing the petitioners to approach the Collector, Siwan in next four weeks and if any petition is filed, the Collector, Siwan shall see to it that the same is taken to its logical conclusion by a reasoned order within a period of six months.

6. The writ petition is disposed of with the aforesaid observation.
