The petitioner is apprehending arrest in connection with Motipur P.S. Case No. 458 of 2019 for offences under Sections 302, 120B/34 IPC.
Allegation against the petitioner is that due to electrocution from the electric current running in the fencing of the field of the petitioner, the son of the informant along with two others died when they came in contact with the fence of the field.
Learned counsel for the petitioner submits that after thought the petitioner has been made accused in this case after five days of the alleged occurrence.
Considering the fact that after thought the petitioner
Patna High Court CR. MISC. No.28423 of 2020(2) dt.18-01-2021 2/2 has been made accused after five days of the alleged occurrence, the Court is inclined to grant bail to the petitioner. Let the petitioner, above named, in the event of arrest or surrender within four weeks from today, be released on bail on furnishing bail bond of Rs. 50,000/- (Fifty Thousand) with two sureties of the like amount each to the satisfaction of the Sub-Divisional Judicial Magistrate (West), Muzaffarpur in connection with Motipur P.S. Case No. 458 of 2019, subject to the conditions as laid down under Section 438(2) Cr. P. C.
