The petitioners apprehend their arrest in connection with Khirjar P. S. Case No. 42 of 2017 instituted under Sections 120B, 420, 364, 367, 369 and 372 of the Indian Penal Code and Sections 4 and 5 of the Immoral Traffic Act.

Learned counsel for the petitioners submits the informant is the father-in-law of the son of petitioner no. 1. Further, it is submitted that due to matrimonial discord between husband and wife, this false case has been lodged with allegation of selling the daughter-in-law of the petitioners no. 1 and 2 rather the impugned order itself disclosed that she was recovered from

No.50098 of 2017 (2) dt.18-10-2017 2/2 the house of the informant by the police and she alleged the allegation of committing cruelty in connection with demand of dowry and rests, petitioner no. 3 is the brother of the husband of the informant's daughter and petitioner no. 5 is cousin and petitioner no. 4 is his wife and they have no criminal antecedent. Having considered the aforesaid facts and circumstances, let the petitioners, namely, Puran Sah @ Puran Sahu, Buchi Devi, Arjun Sah @ Arjun Sahu, Lakhamaniya Devi @ Lakshaminiya Devi and Chhotu Sah @ Chhotu Sahu, in the event of arrest or surrender before the court below within four weeks from today, be released on bail upon furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Benipatti , Madhubani in connection with Khirhar P.S.Case No. 42 of 2017; subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure, 1973.
