JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 24-01-2023 Heard the learned counsel for the petitioners and the learned Additional Public Prosecutor for the State. The petitioners apprehend their arrest in connection with Kawakole P.S. Case No. 275 of 2021 registered for offence punishable under sections 341, 323, 308, 354(A), 379/34 of the Indian Penal Code.
The specific allegation against petitioner no. 1 is that he assaulted Shivam Bharti with iron rod on his head, who sustained grievous injuries.
The learned counsel for the petitioners has submitted that there is case and counter case and both the parties have sustained injuries. Though one of the injured persons has
Patna High Court CR. MISC. No.28140 of 2022(3) dt.24-01-2023 2/2 received grievous injuries, but cordial relation has been restored between them. He has submitted further that the petitioners are the persons of clean antecedents and both the parties have compromised the case.
There is nothing on the record which shows that compromise has taken place. If it is so, the learned court below shall consider the regular bail of the petitioners on the same day on their surrender within four weeks from today.
