2. The petitioner is apprehending his arrest in connection with Laxmipur P.S. Case No. 96 of 2022 for the offence under Sections 147, 148, 452, 307, 427, 435, 504 and 506 of the Indian Penal Code and section 27 of the Arms Act, lodged on 06.04.2022 by the informant, Ajay Kumar Yadav.

3. As per the prosecution story, the informant alleged that the accused persons armed variously attacked them and opened firing. Further, they also put the two motorcycles on fire. The allegation is that earlier the informant's father was killed by Chandan Yadav and others and they are always aggressor. This led to the F.I.R.

4. Though learned counsel for the petitioner tried to impress upon this Court upon about his innocence.

5. Learned APP opposes the prayer for bail submitting that the petitioner was named in the F.I.R. in the year 2022, allegation of firing as also damaging the motorcycle is also there. The anticipatory bail was rejected by the learned Sessions Judge in the year 2023, still, two years taken to approach this Court.

6. Considering the submissions of the parties as also the allegation that has come coupled with the fact that he has delayed coming to the Court, it would be appropriate that he seek bail.

7. The anticipatory bail application stands rejected.

8. However, if the petitioner surrender within a period of four weeks from today, the court concerned shall take up the matter and dispose it of preferably on the same day. (Rajiv Roy, J) vinayak/- U T
