JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 08-04-2022 Heard learned counsel for the petitioner and learned APP for the State through virtual court proceedings. Petitioner apprehends his arrest in Parihar P.S. Case No.182 of 2020, registered for the offences punishable under Sections 384 and 385 of the Indian Penal Code. The petitioner is said to have demanded ransom from the informant.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. It is submitted that the informant is a contractor of Nal Jal Yojana and he was using very inferior quality of the materials in the project which was opposed by this petitioner and this led to scuffle between the petitioner and the informant. It is submitted that the petitioner has been awarded by Bihar

Patna High Court CR. MISC. No.37949 of 2021(3) dt.08-04-2022 2/2 Police for his wisdom and efforts to stop the spread of communal violence in the area. It is also submitted that no independent witness has supported the prosecution case. Learned APP for the State opposes the prayer for anticipatory bail of the petitioner and submits that there is specific allegation against this petitioner to demand ransom from the informant.

Taking into consideration the facts aforesaid, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the prayer for anticipatory bail of the petitioner is rejected.
