JUSTICE KISHORE KUMAR MANDAL ORAL JUDGMENT Date: 30-01-2016 Heard the Counsel for the petitioner and the State. Prima facie, it appears the petitioner is raising a stale claim and/or is not diligent in pursuing his remedy. Initially he was appointed as Assistant Teacher in a School administered by the District Board on 1.3.1966. School is said to have been taken over by the State Government in the year 1973 entitling the employee to get salary at par with the Government Teachers w.e.f. 1.4.1973. The difference of the salary for the period 1.1.1971 to 31.3.1973 was to be deposited in the G.P.F. account of the employee. The respondents authorized the G.P.F. amount in favour of the petitioner on 13.5.2003.

Patna High Court CWJC No.6344 of 2014 dt.30-01-2016 2/2 The G.P.F. amount for the period 1.1.1971 to 31.3.1973 was computed and authorized on 14.3.2007 (Annexure-3). The petitioner remained satisfied therewith and did not raise any grievance thereagainst. In 2014, the present writ petition has been filed with a grievance that the entire G.P.F. amount for the period 1.1.1971 to 31.3.1973 have not been paid and the petitioner would be entitled to get some more amount for the said period which was got deposited in the G.P.F account of the petitioner.

This Court was not inclined to entertain the application, however, considering the fact that it is a claim to which the petitioner may be entitled to from the Government, the application is disposed of permitting him to raise a grievance in this regard by filing an application before the concerned respondent who shall examine the same and take appropriate decision and/or pass appropriate order in accordance with law. It will be open to the petitioner to request for providing calculation of the G.P.F. amount before the said respondent. (Kishore Kumar Mandal, J) Pankaj/- U
