Petitioner apprehends arrest in a case registered for the offences punishable under Sections 379/307 and other allied sections of the Indian Penal Code.
Prosecution's case in short is that the petitioner and other 15/20 unknown miscreants reached informant's site and assaulted his associates with iron rod. They took away Rs.5.38 lacs and damaged JCB machine, electric board, motorcycle and cooler.
Learned counsel for the petitioner submits that the petitioner has been implicated in this case on suspicion as his name has not been figured amongst 15 named accused persons. Petitioner's name has come in the case during investigation as one of the persons who were seen at the place of occurrence.

Considering the facts of the case, let the petitioner, above named, in the event of arrest/surrender before the Court below within a period of six weeks from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Banka in Banka Police Station Case No. 368 of 2018, subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure as well as condition that the petitioner shall fully co-operate with the investigation and trial of the case, failing which the Court below shall be at liberty to cancel the bail bond of the petitioner.
