=========================================================== CORAM: HONOURABLE MR. JUSTICE AHSANUDDIN AMANULLAH ORAL JUDGMENT Date: 17-10-2016 Heard learned counsel for the parties.

The petitioners apprehend arrest in connection with Konch P.S. Case No. 237 of 2015 dated 24.10.2015 instituted under Sections 341/323/307/34 of the Indian Penal Code. After some arguments, learned counsel for the petitioners seeks permission to withdraw the application with liberty to surrender before the Court below, relying upon the observations made by the learned Sessions Judge, Gaya in paragraph-4 of the order dated 04.11.2015 in ABP No. 2496 of 2015, by which their prayer for anticipatory bail has been rejected.

In view of the aforesaid, the application stands disposed off as withdrawn with liberty aforesaid.

No.44058 of 2016 dt.17-10-2016 2/2 In the event the petitioners surrender before the Court below in terms of the order of the learned Sessions Judge, Gaya and seek regular bail, the same shall be considered by the Court concerned, on its own merits, in accordance with law, without being prejudiced by the present order.
