The petitioner apprehends his arrest in connection with Sasaram P.S. Case No. 107 of 2016 registered under Sections 147, 148, 149, 323, 337, 338, 307, 332, 333, 353 and 379 of the I.P.C. and 4/40 of the Bihar Mines Act and sections 33, 41 and 42 of the Forest Act.

The accusation is that on receiving secret information about carrying illegally extracted stone chips through 30-35 tractors at Tendua Cannal, the Police reached there. On seeing the Police Party, 10 to 15 persons boarded on motorcycles and drivers of the tractors started to raise alarm and pelting stones on the Police Party. In the meantime, several villagers also

Patna High Court Cr.Misc. No.38903 of 2016 (2) dt.05-10-2016 2/2 gathered and drivers of the tractors started to flee away, but 23 persons named in the F.I.R. including the petitioner were identified these.

Learned counsel appearing on behalf of the petitioner submits that petitioner has falsely been implicated in this case mere on suspicion. The petitioner is a vegetable vender in the village and he has no criminal antecedent. Having considered the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the C.J.M., Sasaram in connection with Sasaram P.S. Case No. 107 of 2016, subject to the condition as laid down under Section 438(2) of the Cr. P.C. (Rajendra Kumar Mishra, J) Shail/- U T
