It is submitted on behalf of the petitioner that as a matter of fact the petitioner has not withdrawn excess amount and if he would have withdrawn excess amount, there must be his signature on the withdrawal application but there is nothing on the record. Heard learned A.P.P. also, who has also submitted that there is allegation of defalcation of government money. In view of the facts as stated above, in my opinion, let the petitioner surrender before the court below for regular bail and the court below will examine submission of the petitioner, as advanced here and after considering that the allegation against

Patna High Court Cr.Misc. No.385 of 2017 (2) dt.16-01-2017 the petitioner is false and there is no signature on any of the withdrawal application, will dispose of the application without being prejudiced of the order of this Court.

With the aforesaid observation, this application is disposed of.
