Petitioner seeks bail, who is in custody since 04.09.2021, in connection with N.D.P.S. Case No. 82 of 2021 arising out of Chhatauni P.S. Case No. 338 of 2021, F.I.R. dated 03.09.2021 registered for the offences punishable under Section 414 of the Indian Penal Code, Sections 25(1-b)a, 26, 35 of the Arms Act and Sections 8, 20(B)(C)(ii) of the N.DP.S. Act. Learned counsel for the petitioner seeks permission to withdraw this application with liberty to file a fresh application before the learned Court below as the impugned order has already been assailed in Cr. Misc. No. 7431 of 2022. Permission is accorded.
