====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 08-08-2025 Heard learned counsel for the petitioners and learned A.P.P. for the State.

2. Petitioners seek regular bail in connection with Ujiyarpur P. S. Case No. 09 of 2025 in a case registered for the offences punishable under Sections 30(a), 41(1), 41(2) of the Bihar Prohibition and Excise Act.

3. As per the prosecution case, total 1324.32 liters illicit liquor was recovered from seized vehicle bearing registration no. BR 09GA 6398 and these petitioners are alleged to have fled away from the spot.

4. Learned counsel for the petitioners submits that petitioners are neither drivers nor owners of the seized vehicle

Patna High Court CR. MISC. No.30065 of 2025(3) dt.08-08-2025 2/2 in question. Name of the petitioners transpired on the basis of secret information. No incriminating material has been recovered from conscious possession of the petitioners and they are no way connected with the aforesaid recovery. Petitioners are in custody since 21.03.2025.

5. Learned A.P.P. for the State vehemently opposed the bail application.

6. Considering the nature of allegation and period of custody, the bail application is allowed. Let the above named petitioners be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Exclusive Court of Learned Special Judge Excise I, Samastipur in connection with Ujiyarpur P. S. Case No. 09 of 2025.
