JUSTICE AJAY KUMAR TRIPATHI ORAL JUDGMENT Date: 11-02-2016 From the communication of the Superintendent, PMCH, Patna, dated 03.02.2016, addressed to the Deputy Secretary, Department of Education, vide letter No. 1722, it is evident that the medical reimbursement bill was scrutinized and as per the circulars and letters of the Department of Health, Government of Bihar, based on CGHS rate, a sum of Rs.5,34,478/- has been authorized. This was against the expenses incurred by the petitioner for a kidney transplant in a private hospital at New Delhi.

Let the authorities of the Education Department release this

Patna High Court CWJC No.13120 of 2015 dt.11-02-2016 sanctioned amount in favour of the petitioner within a period of six weeks.

So far as discrepancy or difference between the demand made by the petitioner and what has been authorized is concerned, petitioner is given liberty to satisfy the authorities with regard to left over payment, if it is left over at all in terms of the entitlement and the circulars which authorize such payments.

Writ application stands disposed of in terms of the above direction.

So far as post operation consultation and treatment is concerned, that is ongoing and current expenses, which the petitioner is meeting. Petitioner may raise claim of the same and that will also be examined in accordance with the circulars and guidelines issued in this regard.
