JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 12-07-2023 Heard learned counsel for the petitioner and the State. Prayer for bail of this petitioner was earlier rejected by this court vide order dated 17/05/2022 passed in Cr. Misc. No.9251/ 2022.

Learned counsel appearing for the petitioner submits that during the trial the informant has been examined as PW 1 who deposed that it was co-accused, Gaurav Jha who fired gun shot at him. PW 2 and PW 4 have also not supported the prosecution case. Petitioner is in custody since 29/08/2020. Learned counsel appearing for the State opposes the prayer for bail.

Considering the facts of the case, the deposition of informant and the period of custody of the petitioner, let the petitioner, above named, be released on bail on furnishing bail

Patna High Court CR. MISC. No.28777 of 2023(3) dt.12-07-2023 2/2 bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions JudgeXII, Muzaffarpur in connection with Ahiyapur PS case No. 579/ 2020.
