JUSTICE AJAY KUMAR TRIPATHI ORAL JUDGMENT Date: 08-02-2016 So far as claim of the petitioners is concerned, it is their stand that the

relief which they are seeking is identical in nature to what has been already decided and directed in a writ application of Chandeshwar Sao and others Vs. State of Bihar and others, namely, CWJC No. 3335 of 2015, decided on 08/05/2015.

There does not seem to be any serious objection to the stand taken in this regard on behalf of the present petitioners. However, their claim should be surely subject to verification before actual payment. Another thing of significance is the stand taken by the State in its counter affidavit, which is an affidavit sworn by the Registrar cum A O, in the Department of Science & Technology, which indicates in para 8 that a sum of Rs.7, 18, 12,496/- has already been approved in the second supplementary budget in December, 2015 and steps are on for releasing that fund in favour of Patna University.

Let it be made clear that if this fund has not already been released in favour of Patna University since swearing of the affidavit on 11.1.2016, this must be done within a period of eight weeks by the concerned department or the departments as the case may be.

Writ application of the petitioners stands disposed of with above direction.

No sooner the fund is released, the Registrar of Patna University will ensure its payment to the bona fide recipients including the present petitioners without any delay whatsoever.
