JUSTICE ARVIND SRIVASTAVA ORAL ORDER 17-11-2017 Heard learned counsels for the petitioner and the State. Petitioner apprehends arrest in connection with Rautara P.S. Case No. 32 of 2017 registered for the offence punishable under sections 354, 354(A)(D),504/120B of the Indian Penal Code.

Learned counsel appearing for the petitioner submits that petitioner and the niece of the informant are students of the same school. As a matter of fact, on account of Bihar Sthapana Diwas a Prabhat Feri was organized in which some scuffle took place among the students and due to that the present false case has been lodged implicating this petitioner. During investigation nothing has come against this petitioner. The statement under section 161 Cr.P.C. of the victim does not corroborate the prosecution story. Petitioner has clean antecedent.

Srivastava, Additional Sessions Judge-cum-Special Judge, Katihar in connection with Rautara P.S. Case No. 32 of 2017 subject to the conditions laid down under section 438(2) Cr.P.C.
