Apprehending his arrest in Sahebganj P.S. Case No. 207 of 2017 registered under sections 353,338 and 427 IPC and section 3/4 of the Prevention of Damage to Public Property Act as well as section 3/4 of Essential Public Service Act, the petitioner has prayed for grant of anticipatory bail.

On account of death occurring on the road, a mob had assembled and blocked the flow of traffic. It is alleged that the public property was also damaged.

Learned counsel for the petitioner submits that the allegation is general and omnibus.

Considering the features of the case, co-accuseds Md. Rikki and Md. Manjoor have been granted the privilege of

Patna High Court Cr.Misc. No.2813 of 2018(2) dt.15-01-2018 2/2 anticipatory bail vide order dated 22.12.2017 passed in Cr. Misc. No. 62074. A web copy has been handed in which is taken on record marked X for identification.

Let the petitioner above named, in the event of arrest/surrender within four weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Sub Judge-1-cumACJM-1 (West) Muzaffarpur in Sahebganj P.S. Case No. 207 of 2017 on condition that one of the bailors shall be his own/close family member. As soon as the charges are framed the petitioner shall appear in the court below in person on each date fixed thereat. In case of default in doing so, the trial court shall cancel the bail bonds of the petitioner and secure his arrest in accordance with law.
