The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 147, 149, 341, 332, 333, 337, 379, 353, 504 of the Indian Penal Code.
The prosecution case as per F.I.R is that two groups were fighting with each other near Jivan Bigha. After getting the information, the informant along with other police personnel reached there but the F.I.R
Patna High Court CR. MISC. No.28323 of 2022(2) dt.12-10-2022 2/3 named accused persons including the petitioner herein attacked with lathi danda and prevented them from discharging their official duties.
It is submitted by learned counsel for the petitioner that petitioner was not apprehended from the spot. Nothing incriminating has been recovered from the conscious possession of the petitioner. There is general and omnibus allegation against the petitioner. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent.
In the facts and circumstance of the case, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad in connection with Jamhore P.S. Case No. 174 of 2021, subject to the conditions as laid down
