JUSTICE VINOD KUMAR SINHA ORAL ORDER 10-05-2018 The petitioners are apprehending their arrest in connection with Complaint Case No. 2026 of 2017, registered for offences punishable under Sections 406, 420, 468 and 471 of the Indian Penal Code.

Allegation against the petitioners that they took Rs. 2,00,000/-. from complainant in order to execute certain piece of land in favour of the complainant but neither land was executed nor the complete amount was returned as only fifty thousand was returned.

It has been submitted on behalf of the petitioners that out and out false allegations has been levelled and petitioners have

No.27465 of 2018 (2) dt.10-05-2018 2/3 taken only Rs. 50,000/-, which has already been returned to the complainant and this present false case has been filed to extort some more money as there is no proof or any chit of paper that the petitioners have taken Rs. 2,00,000/-.

Heard learned A.P.P. as well as learned counsel for the complainant.

Having heard both sides, in view of the above facts as well as in view of the fact that petitioners are lady, let the petitioners above named, in the event of their arrest or surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bond of Rs. 25,000 (Rs. Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate - XIII, Siwan, in connection with Complaint Case No. 2026 of 2017, subject to the conditions as laid down under Section 438(2) of the Cr.P.C, as well as subject to the following conditions, it is further subject to the condition that:- (i) One of the bailors of the petitioners shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court.
