ANJANA MISHRA ORAL ORDER 27-08-2015 This matter has been brought under the heading "To Be Mentioned" at the instance of the learned counsel for the petitioner.

In the order dated 18.8.2015, it has been noticed that the amount stated to have been deposited by the petitioner i.e, Rs.14,00,000/- was, in fact, the amount deposited by other coaccused. It is submitted on behalf of the petitioner that the said fact came to be recorded under the mistaken impression and, therefore, the order dated 18.8.2015 may be modified to the extent that the petitioner may be permitted to deposit 20% of the amount, as alleged against him in the F.I.R. As such,let the submission of the petitioner and BSFC made out in para no.3 of the said order be treated as wrong and the

Patna High Court Cr.Misc. No.32745 of 2015 (3) dt.27-08-2015 2/2 petitioner is directed to deposit 20% of the amount, as alleged in the F.I.R., within a period of ten months.

In view of the offer made by the petitioner, let the petitioner Sushil Kumar Singh, in the event of his arrest or surrender before the court below within a period of three weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class(InCharge Goh P.S.), Aurangabad, in connection with Goh P.S. Case No.65 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. The order dated 18.8.2015 is modified accordingly. (Anjana Mishra, J) PNM U T
