For the Intervener : Mr. N. K. Agrawal, Sr. Advocate, Mr. Vijay Anand, Advocate For the State : Mr. Alok Kr. Rahi, A.C. to G.P. 21 =========================================================== CORAM: HONOURABLE DR. JUSTICE RAVI RANJAN ORAL JUDGMENT Date: 06-12-2016 Heard parties.
I.A. No.6050 of 2015 has been filed for intervention into the matter as it is submitted that licence was granted to the PACS which was being represented by the writ petitioner, Yugeshwar Paswan in the writ petition. Now the intervener has been elected as President of the PACS and Yugeshwar Paswan is no more President, therefore, she wants to intervene as the writ petitioner. In my view, such interlocutory application intervening as writ petitioner cannot be allowed. However, it also appears from the writ petition that the same has not been filed by the PACS. The petitioner appears to have filed the same in its individual capacity. In
Patna High Court CWJC No.3231 of 2014 dt.06-12-2016 2 / 2 paragraph no.3, he has described himself as citizen of India and has not described that he is the President and representative of the PACS and is filing the petition in such capacity. In such a situation, this writ petition is dismissed with a liberty granted to the intervener to file fresh writ application for redressal of the grievance of the PACS concerned.
