The matter has been taken up through video conferencing.

The petitioner seeks bail in N.D.P.S. case No. 39/ 2019, arising out of Ganga Bridge P.S. case No. 07/2020, registered u/s 25(1-b) a/ 26/35 of the Arms Act and u/s 8/20 (b) (ii) A of the N.D.P.S. Act.

The learned counsel for the petitioner submits that petitioner is in custody since 24.01.2020 for recovery of 2 Kg. Ganja and one country made pistol from his possession. The recovered Ganja is more than small quantity but lesser than commercial quantity. The petitioner has already remained in jail for more than 10 months.

Taking into consideration the facts that only 2 Kg.

Patna High Court CR. MISC. No.28241 of 2020(3) dt.27-11-2020 2/2 Ganja and one country made pistol are recovered from the possession of the petitioner and for that the petitioner has already remained in jail for more than ten months, the petitioner, above named, is directed to be enlarged on bail on his furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-I-cum-Special Judge, Vaishali at Hajipur in connection with N.D.P.S. case No. 39/ 2019, arising out of Ganga Bridge P.S. case No. 07/2020.
