JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 17-10-2017 Heard learned counsel for the petitioner and the State. Petitioner is apprehending arrest in connection with Araria (R.S.) P.S. Case No. 466 of 2017 for an offence under sections 406, 409 and 120(B) of the Indian Penal Code. The allegation against this petitioner is that he played mischief in the matter of receiving benefit under Indira Awas Yojana in connivance with middleman and the then Post-Master. Counsel for the petitioner submits that the alleged amount which was subject-matter of this case is Rs.23900/-. However, beneficiary of that amount has already filed affidavit and exhibited the receipt of the same amount. Considering the peculiar facts and circumstances of the case, the court is inclined to grant bail to the petitioner named

Patna High Court Cr.Misc. No.47195 of 2017 (2) dt.17-10-2017 2/2 above, in the event of arrest or surrender before the court below within a period of four weeks from today on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Araria in connection with Araria (R.S.) P.S. Case No. 466 of 2017 subject to the condition as laid down under section 438(2) of the Cr.P.C. with further condition that the petitioner will cooperate in the investigation and will not, in any manner, influence the evidence or the witnesses.
