JUSTICE BIRENDRA KUMAR ORAL ORDER 18-03-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.
The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 323 and 498A of the Indian Penal Code.
Petitioner is the husband of opposite party no.2. The case is under Section 498A of the Indian Penal Code. The matter was sent for reconciliation. However, due to death of father of the opposite party no.2, no one appeared there.
Learned counsel for the parties submits that the parities are willing to compromise the case before the court below. If the parties show their willingness within six weeks from the date of receipt of the order, the court below, in the
Patna High Court Cr.Misc. No.49088 of 2016 (4) dt.18-03-2017 event of arrest or surrender of the petitioner, shall release him on anticipatory bail, failing which the court below shall be at liberty to consider the prayer for regular bail of the petitioner in the event of surrender according to law.
