17-10-2017 Heard Sri Pawan Kumar Singh, learned counsel for the petitioner and learned Addl. Public Prosecutor. The sole petitioner, apprehending his arrest in Bikramganj P.S. Case No. 239 of 2017 registered for offence under Sections 272, 273 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act, 2016, has prayed for grant of bail in the event of his arrest or surrender. It was submitted by learned counsel for the petitioner that it is a peculiar case that police party has recorded selfstatement and thereafter, an F.I.R. was lodged, in which, it was disclosed that police had got secret specific information regarding movement of liquor in a vehicle, being carried by petitioner and other named accused persons, however; after noticing the police, it was alleged that all the accused persons
Patna High Court Cr.Misc. No.50166 of 2017(2) dt.17-10-2017 2/2 fled away and as such, petitioner was made accused. He submits that it was a case of police itself that vehicle was stopped in the mid-night, however; none of the accused persons were apprehended and thereafter, a false case was instituted and petitioner alongwith others were made accused. Learned counsel for the petitioner has also drawn my attention to the statement made in paragraph - 3 of the petition to show that the petitioner is having clean antecedent.
Considering the facts and circumstances as well as clean antecedent of the petitioner, in the event of arrest or surrender within a period of six weeks from today, let the petitioner namely Rauki Singh @ Ranjan Kumar Singh be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge II-cum-Special Court, Excise, Rohtas at Sasaram in connection with Bikramganj P.S. Case No. of 239 2017, subject to condition as laid down under Section 438(2) of the Cr.P.C. (Rakesh Kumar, J.) anay U T
