The Interlocutory Application has been filed for amendment of prayer made in the restoration application so as to seek restoration of the main LPA No.79 of 1998 also as a consequential relief to restoration of I.A.No.807 of 1998, i.e., the limitation petition.

On a consideration of the facts and circumstances of the case and upon hearing learned counsels for the petitioner and for the State, the prayer for amendment is allowed. I.A.No.690 of 1996 is, accordingly, disposed of. Upon hearing learned counsel for the petitioner and learned counsel for the State, I.A.No.807 of 1998 and consequently L.P.A. no. 79 of 1998 are directed to be restored to

Patna High Court MJC No.4145 of 1998 (5) dt.11-02-2016 2/2 their respective original files subject to the petitioner complying with the order dated 27.01.1998 within a period of one week from today.

The restoration application is, accordingly, allowed subject to the aforesaid condition.
