JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 23-08-2017 Heard learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners apprehend their arrest in connection with Sasaram (Town) P.S. Case no.401 of 2016, registered under Section 366(A)/34 of the Indian Penal Code.

The allegation of informant Sanjay Prasad is that on 17.03.2016, his niece aged about 16 years had gone to school for appearing in the examination, but she did not return. In course of search, the informant comes to know that his niece has been kidnapped by one Fulendra Ram, son of the petitioners. Thereafter, informant went to the house of petitioners and asked whereabouts of his niece stating that Fulendra Ram has kidnapped his niece. The petitioners told the informant that they know the matter and his niece will not be

Patna High Court Cr.Misc. No.45231 of 2016 (4) dt.23-08-2017 2/2 traced out. On 18.03.2016, informant was informed on his mobile that if he would try to search his niece then she will be killed. Learned counsel for the petitioners submits that it would appear from the F.I.R. that the niece of the informant, who is aged about 16 years, is said to be kidnapped by Fulendra Ram, who is son of petitioners, due to that reason the petitioners have falsely been implicated in this case only to give undue pressure, while the petitioner has no knowledge about kidnapping of niece of the informant. Further submission is that petitioners have no criminal antecedent.

Having regard to the facts and circumstances of the case, let the above named petitioners, be released on bail, in the event of their arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Sasaram, Rohtas in connection with Sasaram (Town) P.S. Case No. 401 of 2016, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
