The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 498A of the Indian Penal Code, 1860 and 3/4 of D.P.Act. This is a case under Section 498A I.P.C. The matter was sent for Mediation Centre, however Patna High Court Mediation Centre is not functioning due to Covid-19 effect. Considering the chances of settlement of dispute between the parties, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period
Patna High Court CR. MISC. No.28273 of 2020(3) dt.26-02-2021 2/2 of thirty days from the date of receipt of the order, be released on provisional anticipatory bail on furnishing bail bond of Rs.20,000 (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned court below where the case is pending in connection with Tr. No. 2546 of 2019 arising out of Complaint Case No.C-1731 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further the petitioner shall fully cooperate with the investigation/trial of the case and also the petitioner shall not leave the country without permission of the learned Trial Court, failing which the court below shall be at liberty to cancel the bail bond of the petitioner. on provisional anticipatory bail.
The petitioner shall fully cooperate in the reconciliation of proceeding before the learned court below. If the petitioner would not be cooperative in the proceeding that would be a ground for cancellation of bail bond of the petitioner by the learned court below itself.
