JUSTICE VINOD KUMAR SINHA ORAL ORDER 16-05-2018 The petitioner is apprehending his arrest in connection with Town P.S. Case No. 113 of 2018, registered for offences punishable under Sections 341, 323, 324, 307, 379, 504 and 34 of the Indian Penal Code.

Allegation as per F.I.R that two persons snatched the motorcycle of the informant and people of the locality named the petitioner.

It has been submitted on behalf of the petitioner that he has falsely been implicated in this case and in the F.I.R. itself it has not been disclosed as to who named the petitioner. Moreover, now the compromise has been reached between the parties and he and informant both are students.

Patna High Court Cr.Misc. No.27727 of 2018 (2) dt.16-05-2018 2/2 Heard learned A.P.P. also.

Having heard both sides, considering the fact and circumstances of the case and nature of accusation, I am not inclined to grant the privilege of anticipatory bail to the petitioner, this application is accordingly dismissed.

However, if the petitioner so desire may surrender before the court below and pray for regular bail, which will be disposed of on the merit of the case, without being prejudiced by the order of this Court.
