The petitioner apprehends her arrest in Dalsingsarai P.S. case No. 370 of 2018 registered under Section 323, 341, 354B, 384, 386, 504, 34 of the IPC.

The informant named the petitioner along with three other accused persons and alleged that they all having armed with different weapons came and began to abuse the informant making allegation that it was the informant who had called police in a case of liquor and contraband. They all tried to assault the informant but the informant saved himself. His wife was also dragged.

The learned counsel for the petitioner submits that there is previous enmity. The petitioner is a lady. There is no allegation of assault against the petitioner. The allegation of

Having considered the facts aforesaid and the fact that petitioner is a lady and there is no specific allegation of assault against her, the petitioner, above named, in the event of her arrest/ surrender before the court below within a period of four weeks from the date of receipt/ production of a copy of this order is directed to be enlarged on bail on his furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-I, Dalsingsarai, Samastipur in connection with Dalsingsarai P.S. case No. 370 of 2018, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
