2 A counter affidavit, acceding the request of the petitioner, has been filed by the State which is on record. 3 The grievance of the petitioner was that even though he superannuated on 30.09.2013, he is getting only 90% pension and he has been paid 90% gratuity and no commutation value has been communicated to him.
4 In the counter affidavit by the State, it appears that the State has acceded to the request of the petitioner and the Special
Patna High Court CWJC No.17534 of 2014 dt.30-09-2016 2/2 Secretary to the Government, in the Department of General Administration, has written, by Letter No 11902 dated 01.09.2016, to the Accountant General that because of pendency of a departmental proceeding, his 10% pension and gratuity was kept pending but upon repeal of the situation, the withheld pension and gratuity has been decided to be released and, accordingly, revised PPO has been issued to the petitioner. The said communication is Annexure A to the counter affidavit.
5 In my view, in view of the aforesaid, nothing survives to be adjudicated in the writ petition. The grievance has already been redressed. The writ petition is, accordingly, disposed of. (Navaniti Prasad Singh, J) M.E.H./- U
