Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 420, 467, 471, 414 of the Indian Penal Code read with Section 40 of B.M.M.C. Rules in connection with Aurangabad Town P.S. Case No. 92/2018.
Allegation against the petitioner is of carrying illegal sand without valid challan for the purpose of selling the same. Submission of the learned counsel for the petitioner is that the F.I.R. itself shows that the petitioner had valid challan. Since he is the owner of the said tractor, he has been made accused in this case.
Patna High Court Cr.Misc. No.28228 of 2018 (2) dt.17-05-2018 2/2 Heard learned Additional Public Prosecutor also. Considering the aforesaid facts, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Aurangabad in connection with Aurangabad Town P.S. Case No. 92/2018, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure with further condition that one of the bailors should be close relative of the petitioner and another having sufficient immovable property within the jurisdiction of the court below and the petitioner will co-operate in disposal of the trial and will make himself available before the court and failure to appear on two consecutive dates without any appropriate reason will be liable for cancellation of his bail bond.
