JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 26-02-2016 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing on behalf of the State. This application for grant of anticipatory bail arises out of Belaganj P.S. case No. 166 of 2014, disclosing offences under Sections 147,148,149,452,341,323,307,325,379,504 of the Indian Penal Code.

Learned counsel for the petitioner submits that the police upon completion of investigation has submitted charge-sheet for the offence punishable under Section 325 of the Indian Penal Code and not under other Sections of the I.P.C. He further submits that similarly circumstanced co-accused persons have been granted anticipatory bail by this Court vide order dated 02.02.2015 passed in Cr. Misc. No. 4375 of 2015.

Patna High Court Cr.Misc. No.11912 of 2015 (5) dt.26-02-2016 Considering the submissions that the similarly circumstanced co-accused persons have been granted bail by this Court, this application is allowed.

Let the petitioner above-named in the event of his arrest/surrender within four weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfactiond of the learned Chief Judicial Magistrate, Gaya in Belaganj P.S. Case No. 166 of 2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.

This is subject to the condition that the petitioner shall present himself before the police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
