The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 147, 148, 149, 323, 324, 307, 379, 504, 506 and 427 of the Indian Penal Code.

The prosecution case is that on the eve of Panchayat election the informant was assaulted by accused persons when Lal Saheb Singh, Ashwani Kumar Singh, Abhay Kumar Singh, Sumant Kumar Singh, Prince Kumar and Subhash Kumar came to rescue they were also assaulted. The specific accusation of ordering the assault has been levelled against co-accused Bhulan Singh and

Patna High Court Cr.Misc. No.46230 of 2016 (2) dt.22-10-2016 2/2 Bipin Bharti.

It is submitted by learned counsel for the petitioners that there is a counter version of the occurrence also and opinion with regard to the injury to the informant side has been kept reserved whereas petitioners' side received grievous injury. Statement has been made in paragraph 3 of the petition that the petitioners have no criminal antecedent and co-accused Mohan Singh has been granted anticipatory bail by a co-ordinate Bench of this Court vide Cr. Misc. No. 38255 of 2016. Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-9, Saran at Chapra in connection with Jalalpur P.S. Case No. 78 of 2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Dinesh Kumar Singh, J) DKS/- U T
